Check Your State Telephone Recording Laws

Bank of America has a policy where they can record a telephone call, but the homeowner cannot record the call without their approval, which they will refuse to provide.

Many state laws allow a party to a call to record the call. Virginia is one such state.

Summary of statute(s): An individual who is a party to either an in-person conversation or electronic communication, or who has the consent of one of the parties to the communication, can lawfully record it or disclose its contents. Va. Code Ann. § 19.2-62 (West 2012).

Check the laws in your state. Don’t believe everything that a bank customer service representative tells you.

If your state law allows it, you may and perhaps should record your important telephone calls.
